It is possibly a case of lack of jurisdiction, possibly the competent jurisdiction is the international crimes court.
I think the plantiff posed the wrong question, is not an issue of "employer" but a much higher and significant issue of an "agent of a foreign service," whereas the vatican, an independent country, has obligation under international law to respond of it's crimes, even if the individual criminal can get away with diplomatic immunity.
Maybe the case should be taken to the International Court as a "one" instance, of "crimes against humanity," where the foreign hostile power of the state of the vatican, is using diplomatic immunity to protect the criminals "agents in their service".
